DAPTs are not intended as a shield to protect individuals already under attack from creditors or who have suffered judgments. Rather, DAPTs are designed to reduce the risk of future and unforeseen creditors accessing transferred assets. The U.S. Supreme Court supported this view in a landmark case when it stated that “any businessman has a right…to provide against future misfortune when he is abundantly able to do so.” Please see Tom Greene’s Trusts & Estates article discussing DAPT public policy.
